INFORMATION STATEMENT ON PROCESSING PERSONAL DATA OF CUSTOMERS

 

We, as Maçka Konaklama A.Ş (Pera Palace Hotel) (“Company”), act with utmost sensitivity in terms of the protection of your personal data. With this awareness, we attach utmost importance that all kinds of personal data belonging to all persons related to the Company -including persons that benefit from our products and services as companies- are processed and stored in accordance with Personal Data Protection Law No. 6698 (“PDP Law”). With full understanding of this responsibility and acting in the capacity of “Data Controller” as defined in PDP Law, we process your personal data as explained below and within the limitations regulated by the legislation.

3. Processing of Special Personal Data

According to PDP Law, information about people’s race, ethnicity, political thought, philosophical belief, religion, sect or other beliefs, appearance and clothing, membership to an association, foundation or trade union, health, sexual life, criminal conviction and safety precautions as well as their biometrical and genetic data are special personal data. Our Company sufficiently takes measures specified by Personal Data Protection Board in terms of processing special data. In order to provide better service, our Company shall only process special personal data by receiving the related person’s consent and only in line with the purpose of collection.

 

4. To Whom and for What Purposes the Processed Personal Data Shall be Transferred

5. Method and Legal Reason of Collecting Personal Data

Your personal data are collected by our Company through techniques and process methods in different channels such as website, call center and physical channels within the framework of legal reasons that arise from and are enforced based on the rules of related legislation, contract, demands, commercial practice and good faith which are implemented in the delivery of our commercial services by using channels and performance of our business operations. Your personal data collected for such legal reason may be processed and transferred within the scope of the conditions and purposes of personal data processing stated in Articles 5 and 6 of Law No. 6698 for the purposes given in Articles (b) and (c) of the Information Text.

 

6. The Rights of Personal Data Subject as Stipulated in Article 11 of Law No.6698

If you claim your rights as personal data subjects, our Company shall finalize your claim as soon as possible and within a maximum of thirty days based on the nature of the claim. However, if the process requires additional cost, our Company shall collect the charge determined by the Personal Data Protection Board. In this context, personal data subjects are entitled to:

• Learn whether their personal data are processed or not,

• Request information if their personal data are processed,

• Learn the purpose of processing personal data and whether they are used for intended purposes,

• know the third persons to whom their personal data are transferred at home or abroad,

• Request correction if their personal data are processed incompletely or inaccurately, and request that the third persons to whom such data are transferred are informed accordingly,

• Request that their personal data are deleted or destroyed, if the reasons for processing are no longer available, even if they are processed in accordance with the provisions of Law No. 6698 and other related laws, and request that the third persons to whom such data are transferred are informed accordingly,

• Object to a detrimental result that arises from the analysis of the processed data exclusively via automated systems,

• Claim damages if they suffer loss as their personal data is not processed in accordance with law.

As per the 1st paragraph of Article 13 of PDP Law, you can submit your request to our Company for exercising your above-mentioned rights in written or by means of other methods determined by Personal Data Protection Board. As the Personal Data Protection Board has not determined any methods yet, you should submit your application to our Company in writing pursuant to PDP Law. In this respect, the channels and procedures for submitting your application to our Company within the scope of Article 11 of PDP Law are explained below.
